Holder: Yep, Obama could kill Americans on U.S. soil

US President-elect Barack Obama gives aPresident Barack Obama has the legal authority to unleash deadly force—such as drone strikes—against Americans on U.S. soil without first putting them on trial, Attorney General Eric Holder wrote in a letter released Tuesday.

But Holder, writing to Republican Sen. Rand Paul of Kentucky, underlined that Obama “has no intention” of targeting his fellow citizens with unmanned aerial vehicles and would do so only if facing “an extraordinary circumstance.”

Paul had asked the Obama administration on Feb. 20 whether the president “has the power to authorize lethal force, such as a drone strike, against a U.S. citizen on U.S. soil and without trial.” On Tuesday, he denounced Holder’s response as “frightening” and “an affront to the Constitutional due process rights of all Americans.”

“The U.S. government has not carried out drone strikes in the United States and has no intention of doing so,” Holder assured Paul in the March 4, 2013 letter. The attorney general also underlined that “we reject the use of military force where well-established law enforcement authorities in this country provide the best means for incapacitating a terrorist threat.” Yahoo! Yes, that IS a smiling Obama in the picture. This news will offset his grief over the death of Hugo Chavez.

If Obama “has no intentions” why then is this an issue at all? And the fact that Eric Holder, Mr. Fast and Furious, brings it up and speaks in such a way only makes me wonder just who the 1st target will be.

I have to totally agree with Sen. Rand Paul on this one; it truly is “frightening” and “an affront to the Constitutional due process rights of all Americans.”

Any person, man or woman, Democrat or Republican, that says Obama has the legal authority to unleash deadly force — such as drone strikes — against Americans on U.S. soil without first putting them on trial has just written Barack Obama a blank check to become a vigilante and commit MURDER at will, with no thought of repercussions.

And IF such actions by a President were to take place and said President used the opinion of his Attorney General as citation to his authority to pull the trigger, wouldn’t that AG also be guilty as an accessory to murder?

And being the lawyer that he is, Holder immediately goes into *Cover your ass* mode.

Holder added: “The question you have posed is therefore entirely hypothetical, unlikely to occur, and one we hope no President will ever have to confront.”

But if ANY President ever DID have to confront such an action didn’t Eric Holder just kinda/sorta render an opinion in the Presidents favor?

Eric HolderBut “it is possible, I suppose to imagine an extraordinary circumstance in which it would be necessary and appropriate under the Constitution and applicable laws of the United States for the President to authorize the military to use lethal force within the territory of the United States,” Holder said. “For example, the President could conceivably have no choice but to authorize the military to use such force if necessary to protect the homeland in the circumstances of a catastrophic attack” like Pearl Harbor or 9/11.

To call upon Pearl Harbor and 9-11 in an attempt to broadly justify the use of a drone strike on an American citizen on American soil is another of those *feel good* tactics the Libtards are so fond of.

In the event of an attack on U.S. soil I have to ask this question; what about Posse Comitatus?

Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or the Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both. SOURCE

Concerns about Posse Comitatus have been posed for quite some time, this is from 2008, Is Posse Comitatus Dead? US Troops on US Streets, and while I have full faith in the loyalty of our troops to the American people and the U.S. Constitution, I do indeed have serious fears about the leadership that is in place and exactly WHAT those leaders would try to get our military to do in the name of *following orders*.

We do live in extraordinary times, I only hope we can survive them intact!

  1. It is a truly sad day, It’s bad enough we have Owebama appointing Legislate from the bench Judges to federal courts. Now we have an attorney rewriting the Constitution and the bill of rights from the witness stand? Terrible times indeed!!

In my 55+ years of being a voting citizen of the United States of America, I have never seen anything like this. The Son of a Bitch in the White House has trashed the Constitution, broken the law and ignored and/or gone around the Congress. The House has not the balls to Impeach and Harry Reid’s Senate would not convict anyway. I hope there is a huge backlash on this one.

    F*@! those stupid ass Ni**$rs.

Let him be the first to encounter an armed drone!

Pissed off a bit there little buddy?? 😈

      • Gary says:

Hell yeah I’m pissed off. when a representative of a special interest group [or ethnicity] that accounts for a mere 12.5% of the US population (according to the 2010 US Census), is able to forcibly tell the other 87.5% of this country how to think and behave, pass unconstitutional laws and/or override congress with executive orders, make illegal out of session appointments, prevent Americans from touring the White House THAT WE OWN, etc., I am most certainly pissed off!

  4. Katie says:

Does anyone expect Barack Hussein Obama to step down from the Presidency in 2015? I fear that with this order he will declare himself “Presidente for Life”.

  5. Can you imagine — can you IMAGINE — what would have happened had President Bush or ANY other Republican said this – ??

It would be a Media Apocalypse for weeks and weeks.

The US Constitution burns and no one notices, no one much cares.

Where has my country gone in such little time?

    • TexasFred says:

Where has my country gone in such little time?

      I wish I knew my friend… I really do..

And as you said, if Bush had said this the media would be apoplectic… One other thing, we aren’t seeing the government intervention here in Texas, the MRAPs and so forth, and I know they are out there, but to what end? In FEMAs hands they are a danger, but I can see some serious practicality in Police work, and if used correctly, I can see them as damned useful in FEDERAL hands..

IF USED CORRECTLY.. That’s a damned big IF…

      • When cops buy that stuff they buy Lenco Bearcats or one of its variants; they’re a helluva lot cheaper than purchasing an MRAP. Only the US government can afford those beasts. And from the photos I’ve seen they’ve been repainted NOT in local colors and logos, but in black with Homeland Security logos.

And that’s the Big Question: to what end? I can only think of one primary reason.

  6. This news is nothing earth shattering about this regime. They will do whatever the hell they want, to whoever the hell they want to do it to. Never mind that it is against the law, and never mind that it is against about the constitution and the Bill of Rights.

    Fourth Amendment
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

    Fifth Amendment
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself; nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use without just compensation.

    Sixth Amendment
In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed; which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor; and to have the assistance of counsel for his defense.

    • Gary says:

Hell, Cowboy, the Constitution is mere toilet paper to this administration. It means nothing, represents nothing, accounts for nothing.

Publius Huldah, Lawyer, Philosopher & Logician States:

“…The Constitution is so short,” she continued, because all of the powers enumerated to the Federal Govt are listed in it. “Depending on how you count, we [the people] delegated 21 powers to the Federal Gov’t.” Article 1, Section 8, Clauses 1-16 are those powers.

In regards to the Second Amendment:

“God is the giver of Men’s rights, according to the Declaration of Independence, and the right to defend one’s self and one’s family is not only a right, but a duty and responsibility before God, according to the bible which is a demonstration of our love for others. Therefore, the Second Amendment is not the source of our right. It merely recognizes that the rights to be free from any interference whatsoever to defend ourselves, our families and our communities from attack. This understanding is as old as human history,” she says.

The first things these butt gaskets seek to do is redefine God, then, redefine the constitution to accommodate their asinine ideas. If they can accomplish that, then we are on the fast track to returning to bondage and slavery.

The dumborats have NEVER liked the constitution. They lie, cheat & steal on ALL levels.

The Feds did it at Waco, TX to David Koresh and his “disciples”.
Our present Atty General was there sucking it all up.

  9. LittleOleLady says:

Knowing this as well as everything else he has done.. At what point has he gone over the line into impeachable territory?

  10. Bunkerville says:

And the polls show the majority support this and say ok. They have no idea what lies ahead.

  11. Steve Dennis says:

I couldn’t agree more Fred and I just posted something about this and posse comitatus myself. This is a clear violation in my opinion and the mere fact that Holder can envision any scenario where this is legal is very troubling!

  12. LD Jackson says:

The very sad part about all of this is how blind so many Americans seem to be. They have gotten used to the dark and can not see how slippery this slope really is. We are in a very dangerous place in America.

  13. Robert says:

What I find the most telling is the liberal media and the hollyweird elites are okay with this… Its a lovely precedent this administration is setting. The silence is quite telling. This means that after Obama has done his damage, if we survive past his term and manage to cure the disease, the next POTUS has a lot of range with what they can do.

Just think, a POTUS TexasFred would be able to drone strike the border region and Detroit and San Francisco and and and… And the liberals must stand quiet right? the media will be okay with it too right?

You want the answer? Think of GWB trying this very thing in 2005…. Yeah there’s NO WAY democrats would be okay with it…
